What is Plant-Insurance?
After you have read all of the information about the Plant-Insurance Program, and you are omfortable with it, then fill out the order form below and send it in. This is a manual non-secure order form. If you want, you can print this form out and mail it in with your payment. You can also use PayPal or our Secure Order form. Just make sure to use the Comments Box to let us know about the insurance policy desired. After the form is sent, maybe send a follow-up email just so we are in communication with each other.
We will say Congratulations and Thanks now... this is a reasonable and good way to make the most of your plant purchase!

Basic Coverage -
This is a one-year free replacement policy of any of the trees or plants you purchase from us up to $100. Whether you bought these as Regular order-form items, auction deals, or other Special promotions, we will replace these items for Free, no questions asked. This policy takes effect immediately after the 21-day initial planting period as stated in our regular policies (read: http://www.cdr3.com/shipping). The coverage is for the plants you bought on your order, using the Order Confirmation Number entered above, up to $100 coverage, as per the pricing on your order. There will be a shipping charge of $7.95 due for each shipment of the replacement plants. We may request that the dead plants be returned to us before the replacements are sent. We will ship the replacement plants up to the of maximum the order value (not to exceed $100 in total plant value). The cost of this one-year policy is $14.95.

Extended Coverage -
This is a one-year free replacement policy of any of the trees or plants you purchase from us up to $100. Whether you bought these as Regular order-form items, auction deals, or other Special promotions, we will replace these items for Free, no questions asked. This policy takes effect immediately after the 21-day initial planting period as stated in our regular policies (read: http://www.cdr3.com/shipping). The coverage is for the plants you bought on your order, using the Order Confirmation Number entered above, up to $100 coverage, as per the pricing on your order. There will be No shipping charges for each replacement plant shipment. We may request that the dead plants be returned to us before the replacements are sent. We will ship the replacement plants up to the maximum of the order value (not to exceed $100 in total plant value). The cost of this one-year policy is $19.95.

Premium Coverage -
This is a one-year free replacement policy of any of the trees or plants you purchase from us up to $300. Whether you bought these as Regular order-form items, auction deals, or other Special promotions, we will replace these items for Free, no questions asked. This policy takes effect immediately after the 21-day initial planting period as stated in our regular policies (read: http://www.cdr3.com/shipping). The coverage is for the plants you bought on your order, using the Order Confirmation Number entered above, up to $300 coverage, as per the pricing on your order. There will be No shipping charges for each replacement plant shipment. We may request that the dead plants be returned to us before the replacements are sent. We will ship the replacement plants up to the maximum of the order value (not to exceed $300 in total plant value). The cost of this one-year policy is $39.95.

Gold Coverage -
This is a one-year free replacement policy of any of the trees or plants you purchase from us up to $500. Whether you bought these as Regular order-form items, auction deals, or other Special promotions, we will replace these items for Free, no questions asked. This policy takes effect immediately after the 21-day initial planting period as stated in our regular policies (read: http://www.cdr3.com/shipping). The coverage is for the plants you bought on your order, using the Order Confirmation Number entered above, up to $500 coverage, as per the pricing on your order. There will be No shipping charges. We may request that the dead plants be returned to us before the replacements are sent. We will ship the replacement plants up to the maximum of the order value (not to exceed $500 in total plant value). The cost of this one-year policy is $59.95.

Renew Your Coverage for 1-Year -
You already have a Plant-Insurance policy, and you can Renew it for another year. Just enter your Plant-Insurance Policy Number and/or your Order Confirmation Number so we can access your records. We will keep your current policy in-place for an additional year, a good way to keep the plant replacement costs at the original purchase price! The cost of this one-year policy is $29.95 (if you have the Basic policy, shipping charges will be incurred, as stated).
Note: You can select this renewal option any time from the date of your plant order up until the expiration of your one-year policy. No expiration notice will be sent).

It is important that you the owner of the Plant-Insurance policy knows and understands your rights and responsibilities. Before submitting your claim, please again read the Terms and Conditions. Like all other types of insurance, this is the legal information about the policy. Having purchased the Plant-Insurance policy, you have read and agreed to the terms and conditions.
IMPORTANT NOTE - All Plant-Insurance policies and claims are subject to the following Terms & Conditions:
Plant-Insurance Terms & Conditions: . These terms and conditions constitute a contract with us, the seller, and you, the buyer. The purpose is to define the rights and responsibilities of both parties. By purchasing the Plant-Insurance policy, the buyer agrees to adhere to these terms and conditions. . The Plant-Insurance Policy, hereafter referred to as "insurance", "plant insurance", or "policy", is valid when payment for the plant order and policy has been processed, and, an insurance policy number has been issued. The insurance policy must accompany a purchased plant order, but the policy can be purchased up to 21-days after the plant order has been shipped by us. . Types of Payment: Check, Money Order, and Cashiers Check, Visa/MasterCard, and PayPal(send to: nursery@cdr3.com), using the on-line forms, e-mail, or by regular postal mail. Our regular Gift Certificates are a valid payment method, and can be used in combination with other payment forms. Plant insurance premiums are not refundable, in whole or in part. . Our Mailing Address: Empire National Nursery, LLC 6778 McPherson-Clay Road Liberty, NC 27298 . The Policy Number: Empire National Nursery, Empire National Company, or the insurance underwriter, or other parties representing us therein, hereafter may be referred to as "we" or "us", will set up and maintain a plant insurance policy account and issue a policy number. The policy number will be unique to the purchaser. The policy account will include, the type of coverage, plant materials ordered, actions and correspondence, and any other information we deem appropriate for the policy and plant purchase. ALL information will be held Strictly Confidential. The policy number and information will be supplied to the purchaser either at the time of purchase, included with the plant order, or, set separately afterwards. . Policy Coverage Period: The plant insurance policy coverage period begins after the standard limited replacement policy has concluded (as outlined on the policies webpage), and will be in force for one-year from that date. Any and all claims must be made in writing within the coverage period using the Plant-Insurance Replacement Claim Form. . The policy coverage dates will be noted on the policy information sent, and maintained in our database. No policy expiration notice will be sent. Policy renewals must be made using the Plant-Insurance Order Form, or in writing prior to expiration of the current policy. . Warranties and Claims: Claims must be made in writing by email or by regular mail within the policy period. We expressly warrant that all plants purchased will be in a good healthy condition when they leave the nursery. . Purchase of plant materials must be a valid paid sale in order for the policy to have a Basis. Replacement of plant materials according to the selected policy coverage is made in Good Faith, and, when it is most practical or reasonable to accomplish. Seasonal timing and other factors will influence the replacement shipment, and we will notify the policy holder of possible delays or other concerns. Items do sell out, and if a suitable replacement is not currently available, we reserve the right to ship at a later date, even after a policy may have expired. . We expressly disclaim any other warranties, expressed or implied, productivity or growth performance, results of transplanting or handling, weather-effects, or any other consequential damages. This warranty of and for insurance is Not transferable, and voided if payment for nursery stock and shipping is not made in full. At no time, and in no event, will Empire National Nursery, Empire National Company, or persons representing us therein, be liable for any amounts in excess of the original purchase price of the nursery plants. All products are sold as-is, and there are no warranties herein, expressed or implied, including without limitations, the fitness or merchantability of plants for a particular purpose, except, as replacements as covered and described in the policy. . What Nursery Plants are Covered: The plant materials covered are those purchased at the regular stated prices listed on the online order forms, or printed paper brochures or plant price lists. Discounted, special sales, quoted plant prices, auction items, or any and all other promotionally purchased items are also covered under this plant insurance policy as long as a valid payment has been made and the order is complete, and there is an order confirmation number. . Nursery plants covered under the policy must be have been originally sent via US Postal Service, Ground or Air delivery where there is tracking information available to provide us with proof of delivery. Postal delivery is made using Priority Mail and must have Delivery Confirmation, Signature Confirmation, or/and Delivery Insurance services added at the time of shipment. Ground and Air shipments made by Fed-Ex or other delivery services, must have a customer signature confirmation of delivery. Claims made without such delivery information may be declined. . Replacement of Plant Materials: Nursery stock or plant materials will be replaced after the plant insurance policy holder notifies us in writing within the stated policy coverage period. Replacement plants will be sent as soon as possible or practical, and subject to availability and/or seasonal influences, and, up to the stated dollar policy coverage, in total. Replacement of plants may be the following spring or a time afterwards if the current supply warrants. Plant substitutions may be permitted or necessary if mutually agrees upon. Substitutions may be needed or desired if the originally purchased item(s) are no longer offered or available. We will notify the policy holder of possible delays or other concerns. . Shipping: Replacement plants will be sent Ground delivery, either as soon as the claim is processed and approved, or when we think is best for successful planting. Replacement items can be sent Air delivery (such as 2nd Day), but additional costs will be incurred. Shipping is a management decision, and may take as long as a year depending on availability and shipping conditions, and we reserve the right to ship replacement items at the best time. . Gift Certificates can be sent in lieu of plant materials. Gift certificates or substituted plant items are subject to the stated policy dollar coverage amount. . Policy Approvals and Denials: Approvals and replacements of plant materials is made in Good Faith and as quickly as practical. After the purchaser has notified us of a claim in writing, we will either send the replacement items right away, or let the purchaser know approximately when the item(s) will be sent. Availability and seasonal influences will be factors effecting replacement, as mentioned above. . We may request the purchaser supply us with the original plants before the claim is approved. Postage or shipping cost is the responsibility of the purchaser, and we will not accept collect or COD packages, and not responsible for returned items that are lost in transit. . Replacement claims can be denied, including but not limited to, incorrect or fraudulent payment, inaccurate or false information, and false or misleading information about the buyer, order or/and delivery. A Plant-Insurance Replacement Claim Form must be submitted to request replacement items, incomplete or inaccurate information on the form may deny the claim, or cause additional processing delays. Claims may be denied if found the plants were not correctly cared for, or other abuses and neglect are made. False statements or information about a claim will void the policy. We may request materials be returned to us before replacement plants are sent, and failure in this regard can void the policy. Should the plants arrive in poor condition, or damage to the package, failure to notify us immediately upon receipt may void or delay a replacement request. Disputes involving credit card companies, or third parties will void the policy and all prior agreements. We will remain blameless in any dispute, and will work for the best interest of the customer. We reserve the right to deny any claim with due cause. . Approval and replacement items will be sent as quickly as possible, and as mentioned above. We will make every attempt to help the policy holder.

Delivery - We will send your Plant-Insurance Policy via regular mail, unless enclosed with your order. We have a separate database for this program, so we can always send you a copy. Please keep your policy in a safe place.
IMPORTANT SHIPPING NOTE: Your plant order can be shipped via Priority Mail, Fed-Ex Ground, or Fed-Ex Air services. For Priority Mail shipments, make sure you request Delivery Confirmation, Signature Confirmation, or Delivery Insurance services! For Fed-Ex deliveries, a signature will be needed!
